Protect Your Fleet, Protect Your Business – Expert CDL Defense You Can Trust
The Law Offices of Cesar A. Montalvo defends CDL drivers against all varieties of traffic violations. We fight to reduce penalties, dismiss violations, challenge cases, hold trials or appeal when eligible, all to protect your driving record.
Fight Traffic Tickets & Avoid CDL Points
Unlike regular drivers, CDL holders cannot take defensive driving courses to dismiss traffic tickets. Our firm can challenge the citation in court to get it dismissed or reduced, negotiate with the prosecutor to reduce charges to a non-moving violation (which doesn’t affect your CDL), and prevent points from going on your record, which helps avoid higher insurance costs and employer penalties. It’s possible that we could negotiate a speeding ticket for 15+ mph over the limit down to a minor infraction that doesn’t count as a “serious traffic violation.”
Prevent CDL Suspension or Disqualification
If you’re at risk of losing your CDL due to violations, we can challenge the suspension or request an Administrative License Revocation (ALR) hearing to fight the disqualification. If you’re already suspended, we can work to reduce the suspension period or assist with reinstatement procedures.
Defend Against DUI/DWI Charges
A DUI/DWI is one of the most damaging offenses for a CDL driver. The Law Offices of Cesar A Montalvo can challenge breathalyzer or blood test results, review police procedures to find errors, negotiate for a reduced charge, and help apply for CDL reinstatement if convicted. For example, if you were arrested for DUI in a personal vehicle, we might be able to get the charge reduced to a lesser offense that doesn’t disqualify your CDL.
Representation for FMCSA & DOT Hearings
If you receive violations that affect your CSA score or DOT safety record, our office can challenge inspection results or violations, represent you in FMCSA compliance hearings, and help reduce fines or penalties imposed by the DOT. For example, if you receive an Out-of-Service Order (OOS) for a paperwork error, we may be able to prove it was a clerical mistake and get it overturned.
Expunge or Seal Past Violations
In some cases, we could help remove old violations from your record, if eligible, improving employment opportunities and reducing insurance costs. Not all violations can be removed, but it’s worth checking to see if you qualify.
